Welcome to 305 TCG Exchange. These Terms of Service (“Terms”) govern your use of our website and your purchases from us. By accessing our store or placing an order, you agree to these Terms. If you do not agree, please do not use our site.

1. Acceptance of Terms

By browsing our store, creating an account, or placing an order, you confirm that you are at least 18 years old (or have the permission of a parent or guardian) and that you accept these Terms in full. We may update these Terms from time to time; continued use of the site after changes are posted constitutes acceptance of the revised Terms.

2. Products & Authenticity Guarantee

305 TCG Exchange sells authentic Pokémon Trading Card Game products, including factory-sealed booster boxes, Elite Trainer Boxes, booster packs, tins, and accessory products, as well as individual singles and professionally graded cards.

Authenticity guarantee: every sealed product we sell is 100% authentic and factory-sealed, sourced through authorized distributors and vetted suppliers. We never sell resealed, repacked, or tampered product. Singles are hand-inspected and graded honestly using standard condition grades (Near Mint, Lightly Played, Moderately Played, Heavily Played); the stated condition in each listing is part of the product description.

3. Pricing & Availability

All prices are listed in US dollars (USD) and may change without notice — the TCG market moves fast. The price shown at checkout is the price you pay.

  • If a product is listed at an incorrect price due to an error, we reserve the right to cancel the affected order and issue a full refund.
  • Product availability is not guaranteed until your order is confirmed. High-demand releases may sell out; pre-order quantities are limited and allocated in order of purchase.
  • We reserve the right to limit quantities per customer on any product, and to cancel orders suspected of abuse, reseller botting, or fraud.

4. Payment Terms

We accept major credit and debit cards (Visa, Mastercard, American Express, Discover) and cryptocurrency: Bitcoin (BTC), Ethereum (ETH), and Tether (USDT on the TRON network).

Card payments

Card payments are authorized at checkout through our secure, PCI-compliant payment processor. Orders are not released for fulfillment until payment authorization is confirmed.

Crypto payments

  • You must send the exact order total to the wallet address provided at checkout. Underpayments or overpayments may delay processing while we reconcile the difference.
  • Include your transaction hash (TXID) in the order notes so we can match your payment.
  • Your order is placed on hold until your transaction is confirmed on-chain. No order is packed, shipped, or released without on-chain confirmation.
  • Send only the correct coin on the correct network (e.g., USDT on TRON, not Ethereum). Funds sent on the wrong network or to the wrong address may be unrecoverable, and we are not liable for misdirected payments.
  • Crypto refunds, where applicable, are issued to your original sending wallet — see our Refund and Returns Policy.

5. Order Acceptance

Placing an order and receiving an order confirmation email does not constitute acceptance. We reserve the right to accept or decline any order for any reason, including pricing errors, suspected fraud, or unavailable inventory. If we cancel your order, you will receive a full refund to your original payment method.

6. Shipping Terms

Orders are processed within 1–2 business days. Shipping rates, carriers, delivery timeframes, tracking, and our lost-or-damaged claims process are described in our Shipping Policy, which is incorporated into these Terms by reference. Risk of loss transfers to you upon delivery to the carrier, except as required by applicable law.

7. Returns & Refunds

Returns and refunds are governed by our Refund and Returns Policy, incorporated into these Terms by reference. Key points: a 30-day return window from delivery, sealed products must remain factory-sealed, card payments are refunded within 5–10 business days of approval, and crypto refunds are sent to your original sending wallet within 5 business days of approval.

8. Prohibited Conduct

You agree not to:

  • Use bots, scripts, or automated tools to place orders or scrape the site.
  • Attempt to circumvent purchase limits or payment verification.
  • Submit false information, fraudulent payments, or abusive chargebacks.
  • Interfere with the site’s security or operation, or infringe our intellectual property.

Violation of this section may result in order cancellation, account termination, and referral to law enforcement where appropriate.

9. Intellectual Property

Pokémon and all related properties are trademarks of Nintendo, Creatures Inc., and GAME FREAK inc. 305 TCG Exchange is an independent retailer and is not affiliated with, endorsed by, or sponsored by Nintendo, Creatures Inc., GAME FREAK inc., or The Pokémon Company International.

All content on this site — including text, logos, images, and design — is the property of 305 TCG Exchange or its licensors and may not be reproduced without written permission.

10. Limitation of Liability

To the maximum extent permitted by law, 305 TCG Exchange’s total liability for any claim arising from your purchase or use of the site is limited to the amount you paid for the order in question. We are not liable for indirect, incidental, or consequential damages, including lost profits or collectible value fluctuations. Nothing in these Terms limits liability that cannot be limited by law.

11. Dispute Resolution

We want to make things right. If you have a dispute, contact us first at hello@example.com or (305) 555-0100 — most issues are resolved quickly this way. If a dispute cannot be resolved informally within 30 days, it will be resolved by binding arbitration or in the courts specified below, as permitted by applicable law.

12. Governing Law

These Terms are governed by the laws of the State of Florida, USA, without regard to conflict-of-law principles. Any legal action arising from these Terms or your purchases will be brought in the state or federal courts located in Miami-Dade County, Florida.

13. Changes to These Terms

We may revise these Terms at any time. The updated version will be posted on this page with a revised date, and material changes will be highlighted for at least 30 days. Your continued use of the site after changes take effect constitutes acceptance.
